This Privacy Notice (“Privacy Notice”) describes the privacy practices that Jaxxon LLC (“Jaxxon” or “us” or “we”) follows when collecting and using information about you on our website (https://www.jaxxon.com/), Jaxxon mobile applications, and any other channel or mobile feature that we operate (collectively, the “Site”). You must read this Privacy Notice before using the Site. It describes what information we gather from you and others who visit or use the Site, how we use that information, and what we do to protect it. When you access or use the Site, certain personal information (as defined below), may be collected, transferred, processed, stored, and in certain circumstances, disclosed as described in this Privacy Notice. Capitalized terms used but not defined in this Privacy Notice have the definitions provided in our Terms and Conditions Agreement, located at https://www.jaxxon.com/terms-and-condition (“Terms”). Provisions within the Terms may affect this Privacy Notice with respect to your use of the Site, so please review the Terms prior to using the Site.

DEFINITION OF PERSONAL INFORMATION
Information that we collect about you through the Site will fall into two categories:
(A) "personal information", which means information that can be used to identify you under applicable data privacy laws. The term “personal information” can include information such as your name and e-mail address, but can also include indirect identifiers such as your IP address or device identifier.
(B) “non-personal information”, which means data that is collected in relation to your use of the Site, but which does not identify you and is not directly linked to your personal information. Such non-personal information is not subject to the terms of this Privacy Notice.
Personal and non-personal information are both referenced throughout this Privacy Notice as “information about you”.
Note that we may use non-personally identifiable information, such as anonymized and/or aggregated Site usage data, in any manner that does not identify individual users for the purpose of improving the operation and management of the Site, including to develop new features, functionality, and services, to conduct internal research, to better understand Site usage patterns, to resolve disputes, to troubleshoot problems, to fulfill user requests, or for security and compliance purposes. For the avoidance of doubt, such aggregated or anonymized data does not allow any party to identify you or any other specific user, and is not personal information subject to this Privacy Notice.

INFORMATION WE COLLECT ABOUT YOU
We may collect the following categories of information about you, described in more detail below: (A) information you provide to us directly, (B) information we may automatically collect, and (C) information we receive from third parties.
A. Information You Provide to Us Directly
In using our Site, you may provide us with information which includes, without limitation:

B. Information We Automatically Collect About You
We use tools provided by Google Analytics, Facebook Pixel, Snap Pixel, and other third party analytics service providers (“Analytics Providers”) to collect information about Site usage and the users of the Site. Analytics Providers use tracking technologies to automatically collect certain information from your web browser, mobile, or other device when you visit the Site. Analytics Providers use the information they collect from the Site and other websites to share with us and other website operators’ information about users including age range, gender, geographic regions, general interests, and details about devices used to visit the Site and other websites and purchase items. As such, this information may include, but is not limited to, your IP address, browser type and language, referring/exit pages and URLs, other browser history, platform type, number of clicks, landing pages, the pages you requested and viewed, the amount of time spent on particular pages, and the date and time of your visits. Our collection of this data are described in more detail below.

Cookies. We automatically derive and collect certain data based on your interactions with us on the Site using cookies and similar technologies (collectively, “Cookies”). Our collection of data through Cookies includes information about your browser and Site usage patterns, which may include your IP address, browser type, browser language, referring/exit pages and URLs, pages viewed, links clicked, whether you opened an email, and information about the device you use to access the Site. Our collection of this information allows us to improve your user experience in various ways, such as to personalize our display of the Site to you, to “remember” whether or not you are signed in, and to provide better technical support to you.

Flash Cookies. When we post videos to the Sites, third parties like YouTube® may use local shared objects, known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features. Flash Cookies are different from browser Cookies because of the amount and type of data and how the data is stored.
Please note: If you restrict, disable or block any or all Cookies from your web browser or mobile or other device, the Site may not operate properly, and you may not have access to certain services or parts of the Site. Additionally, Cookie management tools provided by your browser will not remove Flash Cookies. We shall not be liable for any interruption in, or inability to use, the Site or our services or degraded functioning thereof, where such are caused by your settings and choices regarding Cookies.

Pixels (aka web beacons/web bugs/java script). We may use Pixels to automatically record certain technical information about your interactions with us when you visit the Site or otherwise engage with us, to help deliver Cookies on our Site, or count users who have visited the Site or used our services. We may also include web beacons in our promotional e-mail messages or newsletters to determine whether you open or act on them for statistical purposes. “Pixels” are tiny graphics (about the size of a period at the end of a sentence) with unique identifiers used to track certain online actions, movements and related information of Site users. Unlike Cookies, which are stored on a user’s computer hard drive, Pixels are embedded invisibly on web pages or in HTML-based emails. The data we receive through Pixels allows us to effectively promote the Site to various populations of users, and to optimize external advertisements about the Site that appear on third-party websites.

Embedded Scripts. We may use Embedded Scripts to automatically collect information about you about your interactions on the Site. “Embedded Scripts” are programming code designed to collect information, such as the links you click. Embedded Scripts are temporarily downloaded onto your device from our web server or a third party service provider’s web server, and are active only while you are connected to the Site. We use the data collected from Embedded Scripts to provide a better user experience and improve the overall shopping experience on the Site.

Additionally, our use of online tracking technologies may be considered a “sale” or “sharing” under certain laws. To the extent that disclosing information to these online tracking technologies is deemed to be a “sale” or “sharing” under certain laws, you can opt out of these online technologies by submitting a request using the process described in the “YOUR PRIVACY RIGHTS UNDER DATA PRIVACY LAWS” section below. Please note that some of the features of our Site may not be available to you as a result of these choices.
D. Information We May Receive from Third Parties
We may collect additional Information about you from third party websites, social media platforms, and/or sources providing publicly available information (e.g., from the U.S. postal service). For example, if you integrate or link your account on the Site to your account on a third-party’s service or platform (such as Facebook or Shopify), that third party may pass certain information about your use of its service. We encourage you to review the privacy policies and settings of any third-party services with which you interact to help you understand their privacy practices.
If you use such third-party services to access, register for the use of, or otherwise use our site, (a) you acknowledge and agree that we may provide your information to such third parties to enable us to provide the Site to you, and (b) without limiting the Terms and this Privacy Notice, you may be subject to the terms of service with respect to your use of such third-party services. The linked websites and services may collect information about you from you that is not subject to our control. We do not endorse or assume any responsibility for any such third-party services. We are not responsible for any of the content or features or functionality of other linked websites or services. ACCESSING AND UPDATING YOUR PERSONAL INFORMATION.
You acknowledge and agree that you, not Jaxxon, are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and right to use of all information about you that you submit, and for ensuring that any information about you that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Site, the information you receive when using the Site, and our ability to contact you.
When you use our Site, we make a good faith effort to provide you with access to your information and to either correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We do not review for accuracy or update your information regularly, but encourage you to access, review and update your information at any time. We will respond to your request as soon as reasonably possible after verifying your authority to make such requests. Your requests for information about you deletion are subject to Section 6 of this Privacy Notice above and we will delete your information within a reasonable time as required by applicable laws.

B. Disclosing Your Information
Jaxxon allows third parties such as our service providers (e.g., cloud hosting services providers such as Amazon Web Site, as well as other vendors providing web analytics services and other information technology services) to process your personal information to enable us to provide the Site, as well as the other purposes specified in this Privacy Notice. We may also share personal information with third parties when you request that we do so or otherwise give your consent—for example, if you authorize the linking of your account on our Site to your accounts on third-party platforms, we may share your personal information with those third-party platforms as necessary to link your accounts and provide Site in connection with that integration.
In some cases, we may disclose your information to the government or other third parties where we are legally obligated to do so—for example, if such information falls within the scope of a criminal or fraud investigation, or a matter of national security, law enforcement or other issues of public importance.
Lastly, we may also disclose your personal information (without notice to you) if required to do so by law or if we otherwise believe it appropriate and/or necessary: (a) to comply with any decrees, laws and/or statutes or in an effort to comply with any legal process served upon us or upon the Site; (b) to maintain, safeguard and/or preserve our rights or property; (c) act under exigent circumstances to protect the personal safety of our users and/or the public; (d) to complete our obligations in the event that Jaxxon is acquired through a sale, merger, or otherwise experiences a change in corporate control; and/or (e) to enforce our rights and agreements, and otherwise in connection with our Terms and other agreements. We reserve the right to disclose or transfer any information we have about you as part of, or during negotiations of, any merger, sale of company assets, or acquisition, or in any other situation where personal information may be transferred with other assets of Jaxxon.
C. Sale and Sharing of Your Information
While we do not disclose information to third parties in exchange for monetary compensation, we disclose identifiers and Internet and network activity information to third party advertising networks and analytics providers for purposes of marketing and advertising, and to improve and measure our ad campaigns. Such disclosures may be considered “sale” or “sharing” of Information under applicable laws. We do not sell or share sensitive Information, nor do we sell or share information about individuals we know are under the age of sixteen (16). Security Measures
We use certain physical, managerial, and technical safeguards designed to preserve the security of your information that we maintain in connection with your use of the Site. For example, we encrypt all data with secure sockets layer (SSL) or similar technologies when we transmit your information. This, however, does not guarantee that your information may not be accessed, disclosed, altered, or destroyed by any breach of our physical, technical or managerial safeguards. In the event that any of your information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and will notify you, as appropriate, in accordance with pertinent laws and regulations.

We are under no obligation to store such Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Information.

MARKETING COMMUNICATIONS
When you create an account with us or otherwise provide us with your email, we may send you Site-related notices (including any notices required by law, in lieu of communication by postal mail), updates, news, and marketing messages. Email communications you receive from us will include an unsubscribe link and other instructions allowing you to opt out of receiving future emails or to change your contact preferences. If you have an account with us, you can also change your contact preferences by updating your contact information within your account settings. Please remember that even if you opt out of receiving marketing e-mails, we may still send you important service information related to your account and the Site. We do not collect or use sensitive personal information for targeted advertising at this time, nor do we process personal information for automated decision-making purposes. Privacy Rights in California
Under the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”), you have rights to request access to specific information, data portability and deletion, as described below. These rights are not absolute, and in some instances, we may decline your request as permitted by law. Jaxxon may ‘sell’ or ‘share’ your personal information with third parties for purposes of targeted advertising. For information about exercising your right to opt out of the sale or sharing of personal information under the CCPA, please refer to the section “Exercising Data Subject Rights” below.

State Privacy Laws require that we notify you if we use your personal information for “targeted advertising”; this includes the CCPA, which requires that we provide transparency about personal information we “sell” or “share.” As used herein, and for purposes of the CCPA, “sale” means a transaction in which we disclose personal information of a California resident to third parties in exchange for valuable consideration. “Targeted advertising” or “sharing” means selecting advertisements based on personal information obtained from activities of a consumer subject to State Privacy Laws across unaffiliated websites to display certain advertisements to that consumer.
We do not knowingly sell or share information about you of individuals under the age of 16. In the twelve months preceding the date on which this Privacy Notice was last revised, we have “sold” or “shared” information about you for cross-context behavioral advertising purposes as shown below. EU/UK Data Subject Rights
Residents of the European Economic Area (“EEA”) may be entitled to rights under the GDPR. If you qualify, these rights are summarized below.
If you request to exercise your rights under the GDPR, we may require verification of your identity before we respond to any such request. If you are entitled to these rights, you may exercise the following rights with respect to your information that we collect and store:

Exercising Data Subject Rights
Residents of California, Virginia, Colorado, and Texas are entitled to request to exercise their rights as a consumer or a data subject up to twice in a 12-month period, while residents of the remaining Applicable U.S. States are entitled to exercise such rights once every 12-month period. We may charge a reasonable fee for excess requests in the same 12-month period, as permitted by applicable law.
To exercise the rights available to you as a data subject under applicable laws, you may submit a verifiable consumer request to us by using the contact information provided at the bottom of this page.
Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. Your verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with information if we cannot verify your identity or authority to make the request. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically. Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

CHILDREN’S INFORMATION
We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no parts of our Site are directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Notice, then please alert us using the contact information provided at the bottom of this Privacy Notice. If we become aware that we have inadvertently collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without parental consent, we will take reasonable steps to delete it as soon as possible as required by applicable law.

“DO NOT TRACK” SIGNALS
